Schedules and Subjects

Master the 12 Schedules of the Indian Constitution, the division of legislative subjects, and special provisions (Fifth, Sixth, Ninth, and Tenth Schedules) (UPSC GS Paper-2: Indian Constitution).

1. Structural Framework of the 12 Schedules

Schedules are lists in the Constitution that categorize and tabulate bureaucratic activity, policy outlines, and constitutional provisions. They act as detailed appendices to avoid cluttering the primary articles.

5th Schedule	Article 244(1)	Provisions relating to the administration and control of Scheduled Areas and Scheduled Tribes (except AMTM states).
6th Schedule	Articles 244(2) & 275(1)	Administration of tribal areas in Assam, Meghalaya, Tripura, and Mizoram. Uses ADCs with legislative/judicial powers.
7th Schedule	Article 246	Division of powers between the Union and the States through three lists: Union List, State List, and Concurrent List.
8th Schedule	Articles 344(1) & 351	Languages recognized by the Constitution. Originally 14; currently 22. Classical language status is linked to this list.
9th Schedule	Article 31B	Acts and Regulations of state legislatures dealing with land reforms and abolition of the Zamindari system. Added by the 1st CAA (1951).
10th Schedule	Articles 102(2) & 191(2)	Anti-Defection provisions for members of Parliament and State Legislatures. Added by the 52nd CAA (1985); amended by 91st CAA (2003).
11th Schedule	Article 243G	Powers, authority, and responsibilities of Panchayats. Contains 29 subjects. Added by the 73rd CAA (1992).
12th Schedule	Article 243W	Powers, authority, and responsibilities of Municipalities. Contains 18 subjects. Added by the 74th CAA (1992).

Eighth Schedule: Official Languages Evolution

Original Languages (14): Assamese, Bengali, Gujarati, Hindi, Kannada, Kashmiri, Malayalam, Marathi, Oriya, Punjabi, Sanskrit, Tamil, Telugu, and Urdu.
21st Amendment (1967): Added **Sindhi** as the 15th language.
71st Amendment (1992): Added **Konkani, Manipuri, and Nepali** (acronym KMN).
92nd Amendment (2003): Added **Bodo, Dogri, Maithili, and Santhali** (acronym BDMS), raising the count to 22.
96th Amendment (2011): Substituted **Oriya** with spelling **Odia**.

2. Division of Legislative Subjects (Seventh Schedule)

The Seventh Schedule provides statutory backing to Article 246, establishing a federal balance of power by dividing legislative jurisdictions between the Union Parliament and State Legislatures.

42nd Amendment Transferred Subjects (1976)

The 42nd Constitutional Amendment Act of 1976 transferred five subjects from the State List (List II) to the Concurrent List (List III), reducing State List subjects from 66 to 61 and increasing Concurrent List subjects from 47 to 52. These five subjects are:

Education: Includes vocational, technical, and university education.
Forests: Preservation of forests and timber regulation.
Weights and Measures: Setting standards, excluding establishment of standards of weight/measure.
Protection of Wild Animals and Birds: Wildlife conservation and sanctuaries.
Administration of Justice: Constitution and organization of all courts except the Supreme Court and the High Courts.

3. Special Administrative & Regulatory Schedules

The Fifth, Sixth, Ninth, and Tenth Schedules contain specialized administrative, regulatory, and defensive frameworks to manage unique tribal regions, land legislations, and political defection.

Ninth Schedule: Evolution of Judicial Review

Creation (1951): Added by the 1st Constitutional Amendment alongside Article 31B to insulate land reforms from challenges based on Fundamental Rights.
Historical Abuse: Used by subsequent governments to shield politically sensitive non-agrarian laws from judicial review.
I.R. Coelho Case (2007): The Supreme Court ruled that there is no blanket immunity. Laws added to the 9th Schedule after **April 24, 1973** (Kesavananda Bharati judgment date) are subject to judicial review under the **Basic Structure Doctrine**. If they violate Articles 14, 19, or 21, they can be struck down.

Tenth Schedule: Anti-Defection & Speaker's Power

Added by the 52nd CAA (1985) to prevent political defections. Key provisions include:

Disqualification Grounds:
- Voluntary resignation from political party.
- Voting/abstaining contrary to party whip (unless condoned within 15 days).
- Independent members joining *any* party after election.
- Nominated members joining a party *after* 6 months.
Merger Exemption (91st Amendment, 2003): Defection does not apply if at least **two-thirds (2/3)** of the legislative party merge with another party. (The 1985 Act originally allowed a 1/3rd split, which was abolished in 2003).
Deciding Authority: The **Speaker or Chairman** of the House decides disqualification questions.
Kihoto Hollohan Case (1992): The Supreme Court held that the Speaker's decision is subject to **judicial review** on grounds of malafides, perversity, or violation of natural justice, though courts cannot intervene *before* the Speaker's final decision.

Historical Evolution of the Constitutional Schedules

1935 — GOI Act 1935: The Government of India Act 1935 contained 10 schedules, establishing the legal blueprint for division of subjects (Federal, Provincial, and Concurrent lists) and administrative categorization.
1949 — Original Constitution 1949: The Constitution of India, as adopted by the Constituent Assembly, consisted of 395 Articles divided into 22 Parts and 8 Schedules. Schedules 9 to 12 were added later through amendments.
1951 — 1st Constitutional Amendment 1951: Added the Ninth Schedule under Article 31B to protect land reform and agrarian laws from judicial review on the grounds of violating Fundamental Rights.
1985 — 52nd Constitutional Amendment 1985: Added the Tenth Schedule containing Anti-Defection provisions to curb the menace of political defection ('Aaya Ram Gaya Ram' era).
1992 — 73rd & 74th Amendments 1992: Added Eleventh (Panchayats - 29 subjects) and Twelfth (Municipalities - 18 subjects) Schedules, giving constitutional status to local self-governments.

Are the oaths of the President, Vice-President, and Governors included in the Third Schedule?: No. The oaths for the **President** (Article 60), **Vice-President** (Article 69), and **Governors** (Article 159) are contained in their respective constitutional articles, NOT in the Third Schedule.
Which languages were added to the Eighth Schedule by the 92nd Amendment Act in 2003?: Four languages: **Bodo, Dogri, Maithili, and Santhali** (remember the acronym BDMSS). This raised the total number of languages to 22.
Is English listed as one of the 22 official languages in the Eighth Schedule?: No, **English** is NOT listed in the Eighth Schedule. Rajasthani is also not listed, which is a common UPSC trap.

Common Exam Traps

Trap 1: Assuming that the Second Schedule covers the salaries of the Prime Minister and other Ministers. The Second Schedule specifies emoluments only for the **President, Governors, Speaker/Deputy Speaker (LS & SLA), Chairman/Deputy Chairman (RS & SLC), Judges of SC & HC, and CAG**. Ministers' salaries are determined by parliamentary laws separately.
Trap 2: Believing that laws in the Ninth Schedule are completely immune to judicial review. In the landmark **I.R. Coelho case (2007)**, the Supreme Court ruled that laws placed under the Ninth Schedule after **April 24, 1973** (the date of the Kesavananda Bharati judgment) are subject to judicial review if they violate the Basic Structure of the Constitution.
Trap 3: Confusing the administrative bodies of the 5th and 6th Schedules. The **Fifth Schedule** establishes a **Tribes Advisory Council (TAC)** (advisory body), whereas the **Sixth Schedule** establishes **Autonomous District Councils (ADCs)** and Regional Councils, which possess legislative, executive, judicial, and financial powers.
Trap 4: Assuming independent members have 6 months to join a political party without disqualification. A **nominated member** can join a political party within 6 months. However, an **independent member** is disqualified immediately if they join *any* political party at *any* time after their election.
